Terms and Conditions

Mappings provides a simulation tool that lets runners, hikers, and organizations explore digital representations of real-world environments for training and preparation. You pay for access to simulations, subscriptions, or usage hours. You may cancel subscriptions, and refunds are limited. The service is provided “as is.” You assume all risks related to training decisions, activities, and outcomes. By using Mappings, you agree to these Terms.

Mappings, LLC (“Mappings,” “we,” “us,” or “our”) is a Delaware limited liability company operating the Mappings Ultramarathon Simulator Tool available at www.mappings.ai (the “Service”).

Who May Use the Service

The Service is available to individuals and businesses.
You must meet the minimum age requirements applicable to the races, trails, or events you are using the Service to prepare for. If you are under the applicable minimum age, you may only use the Service with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Accounts

You may need to create an account to use the Service.
You agree to: a) Provide accurate and complete information, b) Keep your login credentials secure, c) Use only one account per user.
Account sharing is strictly prohibited. Selling, renting, or transferring accounts is not allowed.
You are responsible for all activity that occurs under your account.

Subscriptions, Access, and Billing

Mappings offers access to the Service through: a) Subscriptions, b) One-time purchases, c) Usage-based credits or hours.
Access to purchased race simulations is granted for one (1) year from the date of purchase unless otherwise stated.
Payments are processed by Stripe, Paypal, or a credit card provider, and your payment information is handled according to the respective provider’s terms and policies.

Subscription cancellations take effect at the end of the current billing cycle.
You may cancel at any time via the “My Account” page.
Notice of cancellation will be provided via email and in-app confirmation.

Refunds

Refunds are offered only in the following cases: a) Refund requests must be submitted within 7 days of purchase. b) Documented service latency exceeding 400 milliseconds across three (3) separate uses, each occurring at least 24 hours apart. c) Refunds in these cases are only available if the user has used fewer than fifteen (15) credits.

No other refunds are provided unless required by law.

Credits

Credits do not expire.
Credits are non-transferable and permanently tied to the purchasing account.
Credits may not be resold, gifted, or shared.

Acceptable Use

You agree not to:
a) Share accounts or login credentials,
b) Sell, transfer, or resell user accounts,
c) Re-broadcast or stream the Service (including screen sharing or live streaming) if viewers may be potential Mappings customers,
d) Use the Service for unlawful purposes,
e) Attempt to reverse engineer, scrape, or disrupt the Service,
f) Create derivative works based on the Service,
g) Conduct competitive analysis, benchmarking, or product comparison for the purpose of building or improving a competing product,
h) Reproduce, use, or display Mappings trademarks, logos, or brand assets without written permission.
Mappings may suspend or terminate accounts that violate these rules.

User Content and Recordings

Users may take screen recordings subject to the following rules: a) Personal, non-commercial use only, b) Clips must be under 30 seconds, c) Mappings must be clearly credited, d) No redistribution that competes with or substitutes for the Service.
All other rights in the Service remain with Mappings.

Intellectual Property

All software, simulations, designs, trademarks, logos, and content provided by Mappings are owned by or licensed to Mappings.
You receive a limited, non-exclusive, non-transferable license to use the Service solely as permitted under these Terms. No ownership rights are transferred.

API AccesS

API access and resale are available only to approved parties under separate written agreements. Unauthorized API use is prohibited.

Third-Party Services

The Service may rely on third-party vendors, including pixel streaming and infrastructure providers such as Vagon.
Outages, performance issues, or failures of third-party services do not impact refunds or credits. Mappings is not responsible for third-party service availability.

Training, Safety, Assumption of Risk, and Waiver of Liability

Mappings provides simulation and visualization tools only.
You acknowledge and agree that: a) Trail running, hiking, and training involve inherent risks, b) Decisions you make based on the Service are your own, c) Mappings does not provide medical, safety, or professional advice.
By accepting these Terms, you assume all risks associated with your use of the Service and waive any claims against Mappings for injuries, losses, or damages arising from decisions or actions taken based on the Service, including training, preparation, or participation in activities.

Disclaimers

The Service is provided “as is” and “as available.”
Mappings makes no guarantees regarding: a) Accuracy of simulations, b) Fitness for a particular purpose, c) Continuous availability or performance.
To the fullest extent permitted by law, all warranties are disclaimed.

Limitation of Liability

To the maximum extent permitted by law: a) Mappings is not liable for indirect, incidental, or consequential damages b) Mappings’ total liability will not exceed the amount you paid to Mappings in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Mappings, LLC and its members, employees, and partners from claims arising out of: a) Your use of the Service, b) Your violation of these Terms, c) Your misuse of simulations or content.

Arbitration and Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, except that either party may bring claims in small claims court if eligible.
Arbitration will be conducted in the State of Delaware under the rules of the American Arbitration Association. You waive the right to participate in class actions or class-wide arbitration.

Termination

Mappings may suspend or terminate your account at any time for violations of these Terms or misuse of the Service.
Upon termination: a) Your access ends immediately, b) Unused credits may be forfeited unless otherwise required by law.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Changes to These Terms

We may update these Terms from time to time. We will notify users via email and in-app notice. Continued use of the Service after changes take effect means you accept the updated Terms.

Privacy Policy

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where your data is sent

Visitor comments may be checked through an automated spam detection service.
